Terms of Service

1. The service

ExclusiveLink provides link-in-bio pages for creators and teams: a hosted page at exclusive.link/handle or on your own domain, with open links, gated links (unlocked by email), paid links (unlocked by payment), scheduling, and click and revenue analytics. Plan features are described on the pricing page and may evolve; we will not materially reduce what a paid plan includes during a period you have already paid for.

2. Accounts

You need a verified email address to hold an account, and you are responsible for activity under it. Keep your credentials to yourself; on team plans, use seats and roles instead of sharing logins. You must be at least 16 years old, or the age of digital consent where you live, whichever is higher. Handles are allocated on a first-come basis, and we may reclaim handles that impersonate others or sit unused on closed accounts.

3. Acceptable use

Your page and the links on it must not be used for:

• illegal content or activity, or content that sexualizes minors in any form;
• scams, phishing, deceptive offers, or selling goods you cannot deliver;
• infringing other people's copyright, trademarks or publicity rights, including on creator pages you run for clients;
• malware, or attempts to probe, overload or disrupt the platform or other users' pages;
• harassment, or the distribution of other people's private data without consent.

We may remove content or suspend accounts that break these rules. Where the breach is not deliberate and can be fixed, we will tell you first and give you a chance to fix it.

4. Payments and fees

Plans are billed in US dollars, monthly or yearly, in advance. On the Creator plan we charge a 2% platform fee on paid-link sales. On Pro and Studio the platform fee is 0%. Payment processor fees are charged by your processor and are separate from, and additional to, anything above. Paid-link sales settle through your own processor account: we never hold your funds, and refunds to your buyers are between you, your buyer and your processor. Plan prices may change with at least 30 days' notice, taking effect at your next renewal.

5. Cancellation

You can cancel from your account settings at any time. Your page stays live until the end of the period you have paid for, after which it is unpublished. You can export your audience data and click records as CSV before or after cancelling; account data is deleted on the schedule described in the Privacy Policy. We may terminate accounts that materially breach these terms.

6. Intellectual property

Your content stays yours. You grant us the license needed to host, display and deliver it through the service, and that license ends when you remove the content or close your account, except for backups on a deletion schedule. The platform, its design and its software remain ours, and no rights in them are transferred to you beyond use of the service.

7. Disclaimers and liability

The service is provided "as is" except where an Enterprise agreement states an uptime commitment. To the maximum extent the law allows, we are not liable for indirect or consequential losses, including lost profits or lost sales, and our total liability for any claim is capped at the amount you paid us in the 12 months before the claim arose. Nothing in these terms excludes liability that cannot be excluded by law.

8. Governing law and changes

These terms are governed by the laws of the State of Delaware, United States, and disputes belong to the courts located there, without prejudice to mandatory consumer protections in your country of residence. We may update these terms; material changes will be announced by email at least 30 days before they take effect, and continued use after that date is acceptance. Questions: [email protected].
